Kaplan 360

Kaplan Singapore hereby grants each user of this Application a personal, non-exclusive, non-transferable, limited and revocable license to use this Application for the Purposes above only on a mobile device owned or controlled by the user and in accordance with the terms of this User Agreement. Any use of this Application in any other manner is prohibited. The terms of this User Agreement also govern any updates, upgrades, supplements or replacements of this Application unless separate terms accompany the update, upgrade, supplement or replacement, in which case those separate terms will apply.

Users of this Application must not post or distribute violent, discriminatory, unlawful, infringing, hateful or other offensive material or information through this Application. Users are individually responsible for all use of this Application through their account, including the safe-keeping of their account details and password. Users of this Application must not defame, stalk, bully, abuse, harass, threaten, impersonate or intimidate any person or entity through this Application, nor distribute or post any confidential or proprietary information belonging to a third party. Violation of these or any other terms of this User Agreement may result in immediate suspension from this Application and/or termination of the user’s account.

Through this Application, Kaplan Singapore may collect, use or store a user’s personal data including, without limitation, the user’s student identification number, address, phone number and other contact details such as the student pass.  Personal data may be disclosed or shared with partner universities and Singapore government authorities such as Skills Future SG.  By using this Application, each user consents to such collection, use and/or storage in accordance with the Kaplan Singapore Privacy Policy, which is a part of this User Agreement. Notwithstanding this, each user remains responsible for the personal data entered into this Application and Kaplan Singapore will not be responsible, to the extent permitted by applicable law, for any damages, costs or expenses, or any loss of personal data, which is caused by, contributed to, or connected with this Application.

All materials included in this Application are owned by or licensed to Kaplan Singapore and all rights are reserved. Users of this Application must abide by all copyright notices and restrictions contained or referred to in this Application in respect of copyright. Users of this Application may not copy, distribute, enter into a database, display, perform, create derivative works of, transmit, or otherwise use any materials from this Application (including computer programs or other code) (“App Materials”).

Users of this Application may not use any Kaplan trademarks, logos or other Kaplan insignia in any manner unless prior written approval is provided by Kaplan Singapore.

This Application may contain links to websites and other applications maintained by other Kaplan businesses and their subsidiaries and/or third parties. Use of each of the Kaplan websites and other applications is governed by its own user agreement and privacy policy, which may be different in some respects from this User Agreement. Where a user of this Application visits or uses a website, of Kaplan or any third party, or another application you should ensure you have read and understood the separate terms of use. Kaplan will not be held responsible for any third party websites or other applications which a user chooses to visit from or through this Application.

This Application and the information, contents, graphics, documents and other elements included herein (collectively the “Application’s Contents”) are provided on an “as is” basis with all faults and without any warranty of any kind provided by Kaplan or any of its affiliates or related entities, including without limitation, Kaplan Inc. (collectively “Kaplan”). To the extent permitted by applicable law, Kaplan hereby disclaims all warranties and conditions with regard to the Application’s Contents, including without limitation, all implied warranties and conditions of merchantability, fitness for a particular purpose, title and non-infringement, except as may be expressly stated in this User Agreement. Neither Kaplan nor any of its officers, directors, shareholders, employees or other authorized representatives will be liable for any damages, costs or expenses, or any loss, theft, or corruption of data, or any damage to any mobile device, arising out of or in connection with the use or performance of this Application, or any of the Application’s Contents. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of all third parties. The contents of this Application could include technical inaccuracies or typographical errors and changes may be periodically made to its contents, and Kaplan Singapore may make improvements, deletions, changes or other modifications to this Application or the Application’s Contents, at any time without notice.

This User Agreement will be governed by the laws of Singapore without regard to any conflicts of law principles. Every user of this Application agrees submit to the exclusive jurisdiction of the courts of Singapore and unconditionally waives any jurisdictional, venue, or inconvenient forum objections to such jurisdiction.

Kaplan Singapore may suspend this Application or terminate this User Agreement at any time without notice for any reason, including for violation of any of these provisions by a user of this Application. The provisions of this User Agreement concerning data protection, copyright, trademarks, links to websites and other applications, disclaimer and limitation of liability, and governing law provisions of this User Agreement will survive the termination of this User Agreement.

Kaplan Singapore reserves the right in its sole and absolute discretion from time to time to vary, amend, delete or add to any of these terms and conditions, at any time without notice, reference or liability.
